What is the purpose of this document?
The purpose of this document is to provide information on the conditions under which Libensky Family Office a.s., Horní náměstí 371/1, 779 00 Olomouc, Company Reg. No.: 04921640 (hereinafter referred to as the “Company”) processes your personal data. Where the text of the Memorandum refers to “us” or “our Company”, it means the above-mentioned Company. This Memorandum shall apply to you if you are:
- A visitor to the headquarters or offices of our Company
- A business partner of our Company or a person representing a business partner
Who is responsible for processing my personal data?
The controller of the personal data, responsible for their due processing, is our Company (see the previous question).

What categories of personal data will be processed?
The Company processes the following categories of personal data:
- 1. INFORMATION ABOUT BUSINESS PARTNERS AND PERSONS REPRESENTING BUSINESS PARTNERS
– Identification data: name, surname, titles, date of birth, place of residence
– Contact details: telephone number, e-mail address, correspondence address
– Bank details: name of the banking institution and account number
– Information on the contractual relationship and its implementation

– Identification data: name, surname
What is the legal basis for the processing of personal data?
The Company processes personal data on the following legal basis
- Fulfillment of obligations arising from legal regulations. The Company processes your personal data, because an obligation is imposed on it by the Commercial Code as well as other legal regulations.
- Performance of the contract. The Company processes your personal data for the purpose of exercising the rights and fulfilling the obligations arising from contracts concluded between you and the Company.
- Securing the legitimate interests of the Company These are cases where the processing of personal data is necessary to protect the interests of the controller and at the same time your interest in the protection of personal data does not outweigh our interest in the related processing.
- Consent to the processing of personal data The Company does not currently process personal data on the basis of consent, however, it may do so if you provide your consent.
For what purpose will personal data be processed?
Your personal data will be processed for the following purposes:
- Preparation of contractual documentation, change of documentation during the contractual relationship

– Legal basis of the processing: performance of the contract - Exercising rights and obligations pursuant to the contract
- The Company processes your personal data in order to fulfill the rights and obligations arising from existing contractual relationships

- Inspection of the insolvency register, lists of international sanctions, etc.
- Legal basis of the processing: legitimate interest, performance of the contract, legal obligations - Accounting and tax obligations, archiving documents
- Legal basis of the processing: fulfillment of obligations arising from legal regulations, legitimate interest - Protection of the Company’s assets
- Legal basis of the processing: legitimate interest - Litigation: determination, exercising, or defending our legal claims, including debt collection
- Legal basis: performance of the contract, legitimate interest - Sending business offers
- We can use your contact details to send offers to expand existing cooperation

Where are my personal data stored?
Your personal data are stored both in electronic and physical (printed) form. Documents in electronic form are stored on local disks of workstations. Documents in physical form are stored in lockers to which only authorized persons have access.
Who outside the Company will have access to my personal information?
We process and store the personal data you provide to us within the Company. If the processing of personal data is based on the legitimate interests and purposes set out above, your personal data may also be processed by external associates of the Company and its contractual partners. We carefully select the entities that cooperate with us on the basis of guarantees, which will ensure the technical and organizational protection of the personal data we transfer.
How long will your personal information be kept by your company?
We process your personal data for the duration of the contractual relationship of the relevant business partner with the Company. After the termination of the contractual relationship, only documents or personal data are kept for which we have a legitimate interest (possible defense of our interests in the event of a dispute), for a period of 10 years from the termination of the contractual relationship with the Company and/or documents or personal data that we are obliged to keep under the law (i.e., in some cases for up to 30 years). In accordance with the principle of data minimization, we only process personal data that we absolutely need for a given purpose and store them for the necessary time. As soon as the given time expires, the personal data are deleted or anonymized.
What are my rights regarding the processing of personal data?
You have the right at any time to request the correction of inaccurate personal data, or their supplementation if it is incomplete. You also have the right to request the deletion of personal data that are no longer needed for the purpose for which they were originally collected or that the controller is no longer authorized to use for other reasons (e.g., they have been processed illegally, their deletion is required by law, etc.).
You have the right to request restrictions on the processing of your personal data. This means that you can ask us not to delete your data, which we would otherwise be required to do, and you can also ask us not to work with your personal data until it is clarified whether the processed data are accurate, or whether your objection to the processing of personal data was reasonably raised (see the right to object below).
You have the right to the portability of your personal data. This means that you can request that we provide you with the personal data we process in electronic form so that they can be easily transmitted to another controller (service provider), or that we transmit these data directly to another controller. This right only applies to personal data that we have obtained in electronic form, based on your consent, or on the basis of a concluded contract.
You have the right at any time to object to the processing of your data for direct marketing purposes (sending business offers). If you do so, your personal data will no longer be used for this purpose.
You also have the right to object to the processing of your personal data, which is based on our legitimate interest. In which case, we will continue to process your data only if it is proven that there are serious legitimate grounds for doing so.
If your personal data are processed with your consent, you have the right to withdraw the consent at any time. The processing of personal data will then be terminated immediately.

How do I proceed if I think the processing of my personal data has violated the law or the GBRD?
In this case, you have the right to lodge a complaint.
Is there automated individual decision-making, including profiling, during the processing of my personal data?
Automated decision-making means a decision made by a machine (computer) without human intervention and that has legal or other similarly serious consequences for you (e.g., non-conclusion or termination of the contract). There is no such processing of your personal data in the Company, the relevant steps are always taken by a specific employee of the Company.
